When Is This Form Used?

An N8 is used by landlords to end a tenancy at the end of the rental term for reasons including persistent late payment of rent, illegal activity in the unit, or the unit being no longer appropriate for the number of occupants. Unlike the N4, the tenant cannot void the N8 by paying rent.

Step-by-Step Guide

    Confirm you have valid grounds
    N8 grounds include: persistent late payment of rent, misrepresentation of income in a subsidized unit, damage to the unit, illegal acts, and the unit being too large or too small for the occupants.

    Complete the N8
    State the ground(s) clearly and give details. The termination date must be the last day of a rental period and at least 60 days from service.

    Serve the N8
    Deliver by an approved method and complete a Certificate of Service.

    File an L2 if tenant stays
    If the tenant does not vacate, file an L2 Application with the LTB.

If You Are a Tenant Receiving This Notice

Receiving an N8 does not mean you must leave automatically. You can contest the eviction at the LTB. The landlord must prove their grounds. If the N8 is for persistent late rent, showing that you have now established a pattern of on-time payment can be a factor in your favour.

How is an N8 different from an N4?
The N4 is for non-payment of rent — the tenant can void it by paying. The N8 is for other grounds (late payment patterns, illegal activity, etc.) and cannot be voided by a single payment.
How much notice is required for an N8?

What counts as 'persistent' late payment?
