When Is This Form Used?

An N11 is a mutual agreement between landlord and tenant to end the tenancy on a specific agreed date. Both parties must sign it voluntarily. It can be used to end a tenancy on any agreed-upon date, regardless of the normal notice periods.

Step-by-Step Guide

    Negotiate the end date
    Both parties agree on the termination date. This can be any date — it does not need to be the last day of a rental period.

    Both parties sign the N11
    The agreement requires signatures from both the landlord and tenant. Ensure both parties have a copy.

    Tenant vacates by the agreed date
    If the tenant does not vacate, the landlord can file an L3 Application requesting the LTB make an order evicting the tenant based on the N11.

If You Are a Tenant Receiving This Notice

Be cautious about signing an N11 under pressure. You give up the right to challenge the end of the tenancy at the LTB once you sign. If you are being offered an N11 in lieu of an N12, you should know that you are waiving the mandatory one-month compensation.

Frequently Asked Questions

Can a tenant be forced to sign an N11?
No. An N11 must be signed voluntarily. If a landlord pressures or coerces a tenant into signing, the tenant can challenge it as an invalid agreement.
Does an N11 waive the tenant's right to compensation?
It can. If a landlord was going to serve an N12 (requiring one month's compensation), getting a tenant to sign an N11 instead avoids that payment. Tenants should consider this before signing.
What if I sign an N11 but can't find another place?
The LTB may still issue an eviction order based on the N11, though in some circumstances a Member may allow the tenant more time. This is not guaranteed.
